"This work examines the tax-exempt status of 501(c)3 organizations under U.S. tax law. Of particular interest in informing this work is the Johnson Amendment and Proposition 8. Questions around tax-exampt status are especially significant in the era of Trump and the rise of the Religious Right. Trump has vowed to overturn the Johnson Amendment, thus making it imperative that we as U.S. citizens increase our understanding of what may come from such an impactful shift in the way churches, and other non-profits, function under the tax code. By using the model of the political organizing efforts of the Mormon Church, namely those seen in the fight for Proposition 8, this work explores the contemporary conversation around "religious freedom" evident in the campaigning and presidency of the Trump administration. The narrative around government oppression of religious freedom will be explored in a historical context to highlight that this narrative, held up by the Religious Right, is both false and dangerous. Using examples of how the Fourteenth Amendment has had to be ideologically stepped on in the name of religious freeom under the First Amendment, I seek to show that the call for removing a key feature of the tax code will only embolden, in both letter and spirit of the law, the Religious Right to further be subsidized in using their influence and power to steer politics in their favor."--leaf 2.
